LTO: List of Traffic Violations, Fines and Penalties

The Department of Transportation and Communications (DOTC) Kagawarán ng Transportasyón at Komunikasyón promulgated a Joint Administrative Order No. 2014-01 dated June 02, 2014 to the Land Transportation Office (Tanggapan ng Transportasyong-Lupa-LTO) for implementation of the revised schedule of fines & penalties for violations of laws, rules, regulations governing land transportation services as follows;

1. Violations In Connection Of Licensing

A. DRIVING WITHOUT A VALID DRIVER’S LICENSE/CONDUCTOR’S PERMIT

This includes the following;

  • Expired
  • Revoked
  • Suspended
  • Inappropriate driver’s license restriction code
  • Fake driver’s license
  • Tourist driving a motor vehicle with a valid foreign driver’s license beyond 90-day maximum allowable period
  • Student driver driving without being accompanied by a duly licensed driver

Fine: Php 3,000.00

For unlicensed or improperly licensed driver

Fines/Penalties:

  • disqualified from being granted a driver’s licensed
  • disqualified driving a motor vehicle for a period of one (1) year from the payment of the Php 3,000.00 fine.

B. DRIVING A MOTOR VEHICLE USED IN THE COMMISSION OF A CRIME UPON CONVICTION BY A REGULAR COURT OF COMPETENT JURISDICTION

Fines/Penalties:

  • Php 10,000.00
  • driver’s license confiscated/revoked
  • disqualified from being granted a driver’s licensed and driving a motor vehicle.
  • motor vehicle impounded

C. COMMISSION OF A CRIME IN THE COURSE OF APPREHENSION UPON CONVICTION BY A REGULAR COURT OF COMPETENT JURISDICTION

Fines/Penalties:

  • Php 10,000.00
  • driver’s license confiscated/revoked
  • disqualified from being granted a driver’s licensed and driving a motor vehicle.
  • motor vehicle impounded 

D. DRIVING A MOTOR VEHICLE WHILE UNDER THE INFLUENCE OF ALCOHOL, DANGEROUS DRUGS AND/OR SIMILAR SUBSTANCE UPON FINAL CONVICTION BY A REGULAR COURT OF COMPETENT JURISDICTION

Fines/Penalties:

For non-professional driver’s license

First Offense

  • driver’s licensed confiscated
  • driver’s license suspended for a period of twelve (12) months

Second Offense

  • driver’s license revoked

For professional driver’s license

First Offense

  • driver’s licensed confiscated
  • driver’s license perpetually revoked

E. RECKLESS DRIVING

Fines/Penalties:

First Offense: Php 2,000.00

Second Offense

  • Php 3,000.00
  • driver’s license suspended for a period of three (3) months

Third Offense

  • Php 10,000.00
  • driver’s license suspended for a period of three (6) months

Fourth/Subsequent Offense

  • Php 10,000.00
  • revocation of driver’s license
  • revoked non-professional driver- disqualified from being granted a driver’s license for a period of two (2) years counted from date of revocation.
  • revoked professional driver-perpetually disqualified from getting any driver’s license.

F. SUBMISSION OF FAKE DOCUMENTS IN RELATION TO THE APPLICATION FOR A DRIVER’S LICENSE (NEW/RENEWAL)

Fines/Penalties:

  • Php. 3,000.00
  • driver’s license put on alarm, revoked and disqualified granted a driver’s license and driving a motor vehicle for a period of one (1) year from the payment of the fine, without prejudice to the filing of appropriate criminal charges.

G.1. FAILURE TO WEAR THE PRESCRIBED SEAT BELT DEVICE

This includes allowing a child 6 years old below to be seated on the front of passenger seat.

Fines/Penalties:

First Offense: Php 1,000.00

Second Offense: Php 2,000.00

Third Offense/Succeeding Offense

  • Php 5,000.00
  • driver’s license suspended for a period of one (1) week from payment of the fine.

G.2. FAILURE TO REQUIRE HIS/HER PASSENGERS TO WEAR THE PRESCRIBED SEAT BELT DEVICE

  • For Public Utility Vehicles, failure to post appropriate signage’s instructing front seat passengers to wear seatbelts when inside the vehicle

Fines/Penalties:

  • Php. 3,000.00 every violation (driver and the operator for the PUJ)

H. FAILURE TO WEAR THE STANDARD PROTECTIVE MOTORCYCLE HELMET OR FAILURE TO REQUIRE THE BACK RIDER TO WEAR THE STANDARD PROTECTIVE MOTORCYLCE HELMET.

Fines/Penalties:

First Offense: Php 1,500.00

Second Offense: Php 3,000.00

Third Offense: Php 5,000.00

Fourth and succeeding offense: Php. 10,000.00 

I. FAILURE TO CARRY DRIVER’S LICENSE, CERTIFICATE OF REGISTRATION OR OFFICIAL RECEIPT WHILE DRIVING A MOTOR VEHICLE

Fine: Php. 1,000.00

J. ALL OTHER VIOLATIONS OF TRAFFIC RULES AND REGULATIONS

  • Wrong Parking
  • Disregarding Traffic Signs
  • Allowing passengers on top or cover of a motor vehicle
  • Failure to provide canvass cover to cargos
  • Permitting passengers to ride on running board, step board, mudguard of MV while the same in motion
  • Failure to dim lights when approaching another motor vehicle
  • Driving on a place not intended for traffic or into place not allowed for parking.
  • Hitching or permitting a person or a bicycle, motorcycle, tricycle or sketch roller to hitch to a motor vehicle.
  • Driving against traffic
  • Illegal turn
  • Illegal overtaking
  • Overtaking at unsafe distance
  • Cutting an overtaken vehicle
  • Failure to give way to an overtaking vehicle
  • Increasing speed when being overtaken
  • Overtaking when left side is not visible or clear of oncoming traffic
  • Overtaking upon a crest of a grade
  • Overtaking upon a curve
  • Overtaking at any railway grade crossing
  • Overtaking at an intersection
  • Overtaking of “men working” or “caution” signs
  • Overtaking at no overtaking zone
  • Failure to yield the right way
  • Failure to stop before traversing a “through highway” or railroad crossing
  • Failure to give proper signal
  • Failure to stop motor notch handbrake of motor vehicle when unattended
  • Unsafe towing
  • Obstruction
  • Overloading motor vehicle

Fine: Php. 1,000.00


2. Violations In Connection With Motor Vehicle Registration/Renewal/Operation

A. DRIVING AN UNREGISTRED MOTOR VEHICLE

Fine: Php. 10, 000.00

B. UNAUTHORIZED MOTOR VEHICLE MODIFICATION

Fine: Php. 5,000.00, motor vehicle impounded

C. OPERATING A RIGHT HAND DRIVE MOTOR VEHICLE

Fine: Php. 50,000.00, motor vehicle impounded

D. MOTOR VEHICLE OPERATING WITHOUT OR WITH DEFECTIVE/IMPROPER/UNAUTHORIZED ACCESSORIES, DEVICES, EQUIPMENT AND PARTS

Fine: Php. 5,000.00

E. FAILURE TO ATTACH OR IMPROPER ATTCHMENT/TAMPERING OF AUTHORIZED MOTOR VEHICLE LICENSE PLATES AND/OR THIRD PLATE STICKERS

Fine: Php. 5,000.00

F. SMOKE BELCHING

Fines/Penalties

First Offense: Fine not exceed to Php. 2,000.00

Second Offense: Fine not exceed to Php. 4,000.00

Third Offense

  • One (1) year suspension of the motor vehicle registration
  • Fine not exceed to Php. 6,000.00

G. FRAUD IN RELATION TO THE REGISTRATION OF THE MOTOR VEHICLE AND/OR ITS RENEWAL

Fine/Penalty:

  • Php. 3,000.00
  • motor vehicle impounded/barred for registration in one (1) year after payment of fine.

H. ALL OTHER VIOLATION IN CONNECTION WITH MOTOR VEHICLE REGISTRATION/RENEWAL/OPERATION

Fine: Php. 2,000.00

3. Violations In Connection With Dimensions, Specifications, Weight And Load Limits

A. LOAD EXTENDING BEYOND PROJECTED WIDTH WITHOUT PERMIT

Fine: Php. 1,000.00

B. AXLE OVERLOADING

Fine: 25% of MVUC at the time of infringement on owner/operator

C. OPERATING A PASSENGER BUS/TRUCK WITH CARGO EXCEEDING 160 KILOGRAMS

Fine: Php. 1,000.00

4. Violation In Connection With Franchise

C. Overcharging/ Undercharging of fare1ST Offense P5,000.00

2ND Offense P10,000.00 and impound unit for thirty (30) days

3RD Offense/subsequent offense P15,000.00 and cancellation of CPC

D. Failure to provide proper body markings-same as above-
E. No franchise/certificate of CPC-same as above-
F. Fake CPC, OR/CR, plates, stickers and tagsRevocation/Cancellation Of CPC
G. Employing reckless, insolent, discourteous or arrogant drivers-same as above-
H. Allowing an unauthorized driver to drive PUV without bringing his/her driver’s license-same as above-
I. Operating the unit/s with defective part and accessories-same as above-
J. Failure to provide fare discount-same as above-
K. Failure to provide the Board with complete, correct, updated operator’s information-same as above-
L. Failure to display “No Smoking” signage or allowing personnel or passengers to smoke inside the vehicle-same as above-
M. Fast, tampered, defective taximeter-same as above-
N. Tampered, broken, joined, reconnected, fake or altered sealing wire 

-same as above-

O. Violation of color scheme or design-same as above-
P. Unregistered or unauthorized trade/business name (PUB & TX only)-same as above-
Q. No Panel Route (PUJ,PUB,UV)-same as above-
R. No sign board (PUJ,PUB,UV)-same as above-
S. Pick and drop of passengers outside the terminal-same as above-
T. Carrying of illegal cargoes-same as above-
U. Failure to provide fire extinguisher and required “STOP and GO” signage for use of each vehicle (STS only)-same as above-
V. Trip cutting (PUJ,PUB,UV)-same as above-
W.Failure to display fare matrix-same as above-
X. Failure to display the International symbol of accessibility inside the units, failure to designate seats for PWDs & refusal to transport PWDs-same as above-
Y. Breach of Franchise conditions-same as above-
